On behalf of Indian People’s Tribunal on Untouchability, we are pleased to invite you to be part of panel of Jurists for the public hearing on the Untouchability Practices Within the Country.

Forty six organizations from across the country and nine national networks working for Dalit Rights are holding the People’s Tribunal on Untouchability on 12 and 13 May 2007 in Indian Social Institute, Lodhi Road, New Delhi to expose the inhuman practices of untouchability that Dalits, who forms a quarter of population in the country, have to face everyday in their life.

The tribunal will hear depositions of 40 personal experiences of untouchability from across India. Two parallel sessions for hearing the cases will be held in two days and a panel of fifteen prominent citizens will look into the issue.

Untouchability practices are a reality that the Dalits have to face everyday in almost every sphere of life. It has become imprinted in the deeper social psyche of the Indian society, in that it stands more or less ignored or is being treated as quite natural. We believe that the opening up of the issue will highlight how the integrated belief system of casteism still perpetuates practices similar to racism within the country. Also, the fact is that it is perpetuated in connivance with the administration and government, and it is hardly treated as a crime within the country. We should be able to bring into national and international attention that despite enacting many legal protective measures within the country, the state has desperately failed to curb this inhuman practice. Any resistance to this practice has resulted in the most inhuman atrocities against the community. Incidents of extreme humiliation, brutalization, maiming, arson, rape, killing, and acts of torture by the community amongst whom they live are quite common.

The tribunal will look into the following issues:-
access to public places, discrimination in common services and criminal justice system; traditional practices like jogini system and devadasi system; discrimination and ghettoisation in housing, access to religious religious places, common natural resources, educational and governmental institutions and work places; implementation of special component plan; manual scavenging; judiciary and judgments on caste related issues.

At the end of the tribunal, the groups involved will be meeting the President, the Prime Minister, the National Human Rights Commission, Scheduled Caste Commission and the leaders of major national parties to brief them on the outcome of the Tribunal. The group involved envisages that the Tribunal will act as a catalyst for influencing the Government policies and programmes, and hopes to see that the Government would evolve with newer approaches to address the issue.

The tribunal will be an indicator for civil society to rethink of a new set of strategies, to compel the State for immediate intervention to address the issue.

Custodial death of an under trial prisoner after brutaltorture in prison Name of victim: Mr. Shaji, aged about 38 years, son of Keshavan,residing at Koyikal Nikarthil house, Kodanthuruthu, Kuthiyathodupost, Cherthala, Alapuzha district, Kerala stateAlleged perpetrator:Mr. Yohannan, Writer, Viyoor Central Prison, Thrissur district,Kerala state, IndiaDate and Place of incident: Between 20 and 22 January 2007 at ViyoorCentral PrisonI am writing to you to express my concern regarding the alleged caseof custodial death of the victim, Mr. Shaji from Kerala state. I aminformed that Shaji, the victim in the case, was an under trialprisoner who was shifted from Kombara Sub Jail in Ernakulam districtto the Viyoor Central Prison on 20 January 2007 due to lack of spacein Kombara prison. I am informed that the Writer at the Viyoorprison, Mr. Yohannan, assaulted Shaji and when Shaji protested hecontinued assaulting him.I am informed that Shaji had filed a written complaint in courtthrough his lawyer when he was produced in court on 22 January 2007,which the court has accepted into records. I am informed that Shajiwas returned to the Viyoor prison on 22 January after his courthearing, but later on the same day night was taken to the ThrissurMedical College where he was declared dead by about 10:00 pm. I amalso informed that the Additional Chief Judicial Magistrate stationedat Ernakulam, Mr. Cheriyan Kuriakose, is conducting a judicial inquiryinto the case.I therefore urge you to make sure that the judicial inquiry into thecase is completed at the earliest, pending which the allegedperpetrator Mr. Yohannan be suspended from service. I also urge youto make sure that an interim compensation be paid to the victim'sfamily and that the perpetrator be brought to trial at the earliestconvenience. I also urge you to take appropriate measures to pressurethe Government of India to ratify the United NationsInternationalConvention against Torture and Other Cruel, Inhuman or DegradingTreatment or Punishment without any delay and make torture a crime punishable in India.I look forward to your immediate and sincere action to this case.

COIMBATORE: "Not Adi Dravidars, we are Scheduled Castes (SCs)," saythe Dalit outfits, which are opposing the latest Government Order (GO)on the SCs to be henceforth referred to as 'Adi Dravidars'.The Dalits are seeing the order as a plan to divide the oppressedcommunities and as an attempt by one section to gain dominance on thebasis of language.Coined by social reformer Periyar E V Ramasami, the term 'AdiDravidar' is used in Tamil Nadu to denote the Dalits. It meansoriginal natives or indigenous people of the Dravida land.Opposing the GO, Puthiya Tamizhagam party leader K Krishnasamy said, "This is an incorrect move, which the government should take backimmediately. "The term Scheduled Caste was coined by Dr B R Ambedkar for the victimsof untouchability throughout India. In Tamil Nadu alone, there areover 77 sections, which come under the Scheduled Castes. Like the SCsin other States, these oppressed communities are entitled to all thebenefits guaranteed under the Constitution. They cannot be separatedfrom the SCs elsewhere, Krishnasamy said.He said he had raised the issue in the State Assembly in the late1990s and Veerapandi Arumugam had assured that the term Pattiyal InaMakkal would be retained."Instead of implementing reservation and other welfare schemes due forthe Dalits, what is the need for the government to come out with thisnew GO," he questioned.Apprehending that the GO would spoil unity among the Dalits in theState, he hoped that the State Government would not go ahead with it.The All India Arunthathiar Munnani, which has been demanding thegovernment to announce the existing 'Adi Dravidar Nala Thurai' (AdiDravidar Welfare Department) as 'Thazthapattor Nala Thurai', hasdenounced the order. Eswara Vel, leader of the outfit, said'Arunthathiars' , mostly Telugu and Kannada-speaking population, arethe most oppressed living in the State.Recalling the 'insulting comments' made by DPI leader TholThirumavalavan like, "We'll allow them ('Arunthathiars' ) to live, butnot rule," and "Arunthathiars should be removed from the SC category,"Vel said his outfit has given 15 days time for Thirumavalavan towithdraw his comments. If he refuses, they would launch a State-widestir, he added."Thirumavalavan will be blocked by our cadre wherever he goes.Moreover, we have also asked the 'Arunthathiars' in the DPI to comeout of that party," he said.

Reservations for recruitment to government offices and for admissions to educational institutions are provided for SCs among Hindus in order to right the historic injustice of untouchability and poverty imposed upon them. In a way the other Hindu castes are paying reparations for the wrongs that their ancestors had done and they don’t grudge too much. The little grudge that they have is that those who had benefited by reservations are having their children and grand children also benefit from reservations thus creating a new privileged caste (called “government Brahmins” in Maharastra). For example: Sri K.R.Narayanan was the President of India. He belonged to the SC. He married a Burmese Christian Lady. He was nominated to the Indian Foreign Service by Jawaharlal Nehru on recommendation from a “socialist” professor in the London School of economics in the UK. Other people to the IFS had to appear in the competition exams and get selected. Sri Narayanan had his daughter educated not only in India but even in Harvard and yet in the competitive exams she could not make the grade along with the OCs. Therefore, she got selected as a SC candidate. Her father was an IFS officer, was an Ambassador, was Vice-President of India and yet she claimed the benefit of reservation. It is this type of benefiting for generations in the dynasty that is presented. Supreme Court called this the creamy layer and opined that the creamy layer should not be given any more reservations. I mentioned in these pages some time ago that a survey among those who are passing off as SC officials and officers in the Secretariat of the Government of Andhra Pradesh (GOAP) revealed that 85% of them are in fact practising and active Christians and some of them are even militant Christians. They had however falsely declared that they were SCs and so benefited from reservations. Some of these are Stanley Babu who retired as General Manager of the South Central Railway; Sri Bhagwan Das who retired as Principal General Manager and Sri Danam IAS. I had written to every one of to truthfully let us know whether in the applications for the job/examination they declared themselves as SC Hindus or Christians. None of them is replying. On the 6th of June I chanced to meet Sri Bhagwandas, retired PGM during my morning walks. He a retired Postal Officer was recently appointed as Adviser to the GOAP’s APIIC! You can guess why. I asked him whether he received my letter got the job as a Christian or ST Hindu. He told me that his father was Hindu and therefore he entered his name as Hindu SC but that he changed his religion later on, out of conviction. This is untrue. I told him that it is unbecoming of Christian followers of the righteousness Jesus Christ to tell lies. I further asked whether after becoming Christian, he did not avail of the SC caste for his promotion in the department. He did not give me a straight reply. This shows that the suppression of fact of conversion is deliberate and planned one. What is designed to benefit the discriminated among the Hindus in the past is being fraudulently utilized by organized Christendom. That this is a fact is evident from another encounter that I had. Once I was debating the issue of conversions on a TV Channel with the Secretary of some association of Churches. He said that the government statistics which places the Christians in Andhra Pradesh as 1.44% is wrong. It is actually about 10%. I asked him how could this happen because the enumerators are entering what the people tell them is their caste or religion. Readers must also be knowing that on several occasions various Christian organizations demanded of all political parties to give 10% of the MPs and MLAs and other elective seats for Christians because their population is truly about 10% and only by government census it is 1.44%. Now that we have a foreign- born Christian as the Supreme Leader of the Congress party and several Christians and crypto-Christians as Chief Ministers in several States, India is experiencing in effect the rule of a minority that. There are three Christians and six Moslems in the dozen or so persons in the inner intimate advisory circle of Sonia Gandhi. The Christian CM and a Christian Secretary of the Panchayati Raj of the GOAP issued a GO that two only of the seven hills belong to the TTD and other five are government property! This is a prelude to allowing Christians to propagate and evangelize on those five hills and build churches. This shows how the foreign -born Roman Catholic Christian Sonia as a President of the Congress and Supreme leader of the UPA is introducing Christian rule in India. The attack by Christians on Hindus is unprecedented. The government is in their side. Dalit converts are becoming militantly anti-Hindus. They are crypto-Christians. They are invoking a 1989 Act, Suppression of Atrocities against Dalits to in order to terrorize the Hindus into silence against the fraudulent conversion activities that they are paid for by foreign conversion enterprises.
